Is CBD Hemp Oil Legal in Indiana?

Residents of Indiana are currently allowed to use and distribute CBD oil with less than .3 percent THC. CBD hemp oil is legal in Indiana, and all CBD products are required to meet labeling requirements. Although this state was initially anti-cannabis, it passed several laws that have made it more open to CBD derived from hemp.

The Indiana State Chemist and Seed Commission regulate the growing and handling of industrial hemp in the state. CBD growers and holders are required to obtain a permit from the state. Cannabis products that contain more than .3 percent THC is considered illegal in the state of Indiana.

Indiana residents may use and distribute CBD products with less than .3 percent THC based on independent lab results. In addition, all CBD products must contain some contain information about:

  • Product name
  • Batch date
  • Expiration date
  • Batch ID number
  • Ingredients
  • The name of the manufacturer
  • Milligrams of CBD the product contains
  • Certificate of analysis

The certificate of analysis should provide details indicating the product contains less than .3 percent THC. Unlike CBD, THC is psychoactive and is associated with various side effects in both humans and animals. A common effect of THC is the euphoric high people experience when they consume products with the chemical compound.

Historically, Indiana has been an anti-cannabis state. Many legislators drafted bills to develop a medical marijuana program, but none of them were ever passed. Currently, the use and distribution of marijuana and its products are illegal in Indiana.

In 2014, the then Governor of Indiana, Mike Pence, signed IC 15-15-13, authorizing the Office of Indiana State Chemist (OISC) and the Indiana Seed Commissioner to regulate the production and distribution of industrial hemp in the state. Despite the legislation, residents of Indiana could still not access hemp-derived CBD products.

In 2017, Governor Holcomb signed House Bill 1148, legalizing the use and distribution of CBD products containing less than .3 percent THC to epilepsy patients. This allowed CBD to be prescribed to epilepsy patients whose symptoms could not be treated by traditional therapies.

In 2018, Governor Holcomb passed Senate Bill 52, legalizing the sale and distribution of CBD outside the medicinal purposes provided the product contains less than .3 percent THC and meets labeling requirements. In 2019, Indiana passed legislation that aligned its terminology regarding CBD use and distribution with the federal government’s. 2019, the legislation also banned the selling and distribution of smokable hemp.

Since 1937, Indiana has had some of the most stringent marijuana laws in the U.S. However, the state has slowly been moving towards legalizing marijuana and cannabis products since the 2010s.
